Henex AI Law Enforcement Request Policy

Our Standard

Henex AI respects legitimate public-safety investigations and the privacy and due-process rights of its users. We disclose customer data only when we reasonably believe a request is legally valid, binding on the relevant Henex AI entity, appropriately authorised, specific, and consistent with applicable Nigerian and international law.

Required Request Information

Requests should identify the requesting authority and officer, legal authority, relevant account or workspace, specific records sought, applicable time period, return contact details, and any confidentiality requirement. They must be sent from an official government address to legal@henexai.com. This address does not waive formal service requirements.

Review, Scope, And Challenge

We authenticate the requester, assess jurisdiction and legal process, and interpret requests narrowly. We may seek clarification, require proper process, challenge an unlawful, overbroad, disproportionate, or technically infeasible request, or disclose less information when that is sufficient. We do not provide governments with direct or unrestricted access to our systems, encryption keys, or customer accounts.

User Notice

We aim to notify the affected customer before disclosure and provide a reasonable opportunity to seek protection, unless notice is legally prohibited, would create a demonstrable emergency risk, or would compromise a lawful investigation. If a prohibition expires, we may provide delayed notice where lawful and appropriate.

Emergency Requests

In a documented emergency involving an imminent risk of death or serious physical harm, we may voluntarily disclose limited information where permitted by law and necessary to address the emergency. The requester must describe the threat, explain why normal legal process is insufficient, and certify the information provided. Emergency treatment is not available for routine investigations.

Preservation And Confidentiality

A valid preservation request may temporarily preserve identified records that already exist; it does not compel ongoing surveillance or disclosure. We protect request records, limit internal access, document disclosures, and retain them according to our Data Retention Policy and applicable law.

Cross-Border Requests

Foreign authorities may need to use an applicable mutual legal assistance process, treaty, court, or other recognised channel. We assess cross-border disclosures under the Nigeria Data Protection Act 2023 and any other applicable transfer and secrecy requirements.
